New parliamentary answers, an investigation into RWE and European plans for bioenergy make one question urgent: why provide new financial support before the sustainability of the wood has been independently established?

The Dutch government is counting on 70 petajoules of biomass for electricity generation in 2040. If this were to consist exclusively of wood pellets, that would mean approximately 4.1 million tonnes of wood pellets every year. This is revealed in answers given by Minister Van Veldhoven to parliamentary questions on 21 October. The National Energy System Plan leaves open where the required biomass is supposed to come from. On Monday, 26 October, the House of Representatives will discuss this plan. But that is the wrong order. Anyone planning to continue relying on forest biomass on this scale must first be able to demonstrate that the wood being used is genuinely sustainable. And according to The Clean Air Committee, this is precisely where the system falls short.

On 10 September, both ZEMBLA and NRC journalists Karlijn Kuijpers and Bas Haan reconstructed how Malaysian wood pellets ended up at energy company RWE in the Netherlands carrying the “sustainable” label. Their investigations showed how vulnerable the oversight system was. Police are now investigating following our criminal complaint.

Reconstruction through Freedom of Information documents reveals troubling findings
Many of the documents behind that reconstruction were obtained by The Clean Air Committee through the Dutch Open Government Act (Woo). They reveal an uncomfortable contradiction: the regulator identified serious shortcomings, yet the government did not intervene. At Malaysian producer Rainbow Pellet, the classification of wood as waste or residue was largely based on self-declarations from 97 suppliers. The Dutch Emissions Authority (NEa) examined underlying delivery documents from four suppliers. Under the Green Gold Label certification scheme, physical checks at the suppliers’ source locations were not mandatory. The NEa also established that at least 500 tonnes of material, equivalent to a larger quantity once converted into pellets, had incorrectly been classified as residual wood.

That may sound like an administrative issue. But that is precisely where the crux lies. Sawmill residues are subject to less stringent sustainability requirements than wood sourced directly from forests. A tree trunk does not become waste simply because it is sent through a sawmill. Nevertheless, the NEa concluded that the deliveries it examined complied with the applicable requirements. The minister decided not to take enforcement action. The NEa says that the certifier involved correctly applied the rules that were in force at the time and points to vulnerabilities in the system. RWE relies on certification. But compliance with a certification scheme is not the same as independent evidence of the original forest origin of the wood. The government must not erase that distinction through administrative definitions, especially when public money is at stake.

The Netherlands is financing clear-cutting around the world
Zembla travelled to Malaysia and filmed entire tree trunks at a pellet producer. The programme also documented links to logging in vulnerable tropical forests. This does not prove that every pellet shipped to the Netherlands comes from deforested areas. It does, however, demonstrate why a system in which verification largely begins at the processor may be inadequate to protect forests. Meanwhile, Brussels is making new financial support for the industry possible. The European Commission wants to create 250 million additional emission allowances, with the proceeds used, among other things, to finance permanent CO₂ removal through bioenergy. According to environmental organisation Fern, this could channel billions in public funding towards bioenergy and potentially biochar.

On 15 October, European Commissioner Wopke Hoekstra met with forest owners and representatives of the timber and paper industries to discuss new business models for forestry and CO₂ storage. The published list of participants contained no independent environmental organisations. One day later, Mighty Earth published research into lobbying surrounding the European deforestation law. Over a two-year period, the legislation was the subject of at least 351 meetings between companies, industry associations and European policymakers. The sector argues that the rules must be workable and that they impose excessive administrative burdens. But anyone seeking to weaken origin-tracing requirements while evidence from the field shows how vulnerable the classification of wood as “residual material” can be must explain how forests are supposed to be protected under such a system.

Scientific research also calls for caution. Guo, Prestemon and Henderson show in a recent modelling study that stricter European traceability requirements could primarily shift the global pellet trade towards markets with weaker regulations, while overall production would decline only marginally. In that case, the pressure on forests may disappear from Europe’s accounting system — but not from the forest itself.

Criminal complaint against RWE and legal action against the Dutch State
This is not an argument against all forms of biomass. It is about the large-scale burning of wood and whether the government is justified in providing billions in subsidies for a climate measure whose sustainability is not being adequately and independently verified. RWE received subsidy commitments with a maximum value of approximately €2.5 billion. Research by The Clean Air Committee Biofuelwatch raised serious questions about the origin of the wood, the reliability of certification and government oversight. Our criminal complaint against RWE and the parties involved is now being investigated by the police. Whether criminal offences have been committed remains to be established. But that does not remove the government’s responsibility. Quite the opposite. Precisely because the State itself establishes the sustainability requirements, provides the subsidies and is responsible for oversight, The Clean Air Committee is preparing a civil lawsuit against the Dutch State.

The aim of this lawsuit is to ensure that the State actually fulfils its own responsibility for effective oversight and enforcement. Private certification must not become a substitute for independent verification. And when reliable evidence of sustainability is lacking, the government should intervene rather than continue providing subsidies. That is what makes Monday’s parliamentary debate on the National Energy System Plan, 26 October, so important. The question on the table should not simply be how much biomass the Netherlands intends to use in 2040, but above all what evidence that decision is based on.

Anyone who cannot independently demonstrate the origin and sustainability of wood at its source should not receive subsidies for burning it. Evidence first. Public money second. Not the other way around.

https://www.bnnvara.nl/joop/artikelen/kabinet-rekent-op-miljoenen-tonnen-biomassa-maar-weet-niet-waar-het-hout-vandaan-komt On Monday, the Dutch House of Representatives will discuss the future energy system.
